Prosecution will have a tough job proving this one, says lawyer

The four Americans arraigned on internet gambling charges in Utica, New York state last week (see previous report) will not go down without a fight, reports local television station WKTV. The four entered Not Guilty pleas before the court Monday, and one of their legal representatives has opined that the prosecution will be hard pressed to separate the confiscated monies from the funds of other legitimate businesses owned by the accuseds.

Richard Dorsagno Sr. and John Swift have been charged with a total of 33 counts of promoting gambling and possessing gambling records. Richard Dorsagno Jr., and Susan Dorsagno, Richard senior's wife, have also been charged with promoting gambling.

The charges follow a two year investigation, with prosecutors claiming that Dorsagno senior and John Swift acted as book makers and took bets, operating via an unnamed internet sports betting website.

Assistant District Attorney Grant Garramone revealed that state police and the Oneida County District Attorney's Office confiscated roughly $220,000, several vehicles, computers and gambling records during on the home and businesses of the accuseds including the East Utica bar Ricks Place.
